Wine tourism Galicia is a marketing platform (e-marketplace) of tourist experiences, activities or services related to wine tourism and gastronomy.

ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF USE AND ACCESS TO THE WEBSITE

You, as a user and / or client of this website, show that you understand and accept these General Terms and Conditions of Use, which define the rights and obligations of the Marketing Platform, adhered partners and you as a client / user to the hiring of tourist experiences, activities or services.

Without prejudice to these general terms and conditions, it is possible that some tourist experiences, activities or services have specific contracting conditions, which, in any case, will be clearly specified on the purchase page.

User registration is not required to access the Website. However, to be able to contract the services offered, the User’s registration and acceptance of these conditions is required before formalizing the corresponding payment.

PURCHASE OF EXPERIENCES

The purchase of tourist experiences, activities or services will be completed by adding those that are of interest to the shopping cart.

Once all the tourist experiences, activities or services of your interest have been added to the cart, you must provide your personal data in the next step to be able to formalize the purchase and issue the corresponding invoice. You agree to provide us with true, accurate, current and complete information about your identity.

It will also be possible at this time to create a user account, through the corresponding registration of your data in the Marketing Platform. In this way, you will have a private area where you can consult and manage all the transactions carried out. You will be responsible for the management of this area through your username and password. We are not responsible for the misuse of your access credentials, which you must not share or reveal to third parties. If you experience any incident, you should contact the email immediately through our contact form to restore your account and user password.

The information shown on the tourist experiences, activities or services in the Marketing Platform is based on the information provided by the adhered partners, who are solely responsible for the inaccuracy of the descriptions.

The Galicia Enoturismo Marketing Platform will act as a one-stop shop where you can make purchases of one or more products or tourist activities that are offered on the Platform simultaneously.

The Enoturismo Galicia Marketing Platform does not sell tourist experiences, activities or services, but rather acts as a technological support platform for the adhered partners so that they can offer their experiences, activities or tourist services that users / clients will contract directly with the adhered partner.

The Marketing Platform does not provide the services that you acquire through the website (experiences, activities or tourist services) but are provided and executed directly by third-party companies called “adherent partners”.

You, as a user / client, at the time you formalize the purchase, will establish a direct contractual relationship with the adherent partner with whom you have booked the tourist experiences, activities or services.

SENDING THE DOCUMENTATION

Once you have successfully completed the purchase process, you will receive an email from the Marketing Platform confirming your order, which will include a summary of your purchase (experiences, number and total economic amount, among other information), without detriment to the subsequent sending of the invoice by the adherent member.

In the confirmation email you will receive all the information related to your purchase, including the links to the general and particular conditions of the contracted tourist experience, activity or service, as well as the vouchers, tickets or documents proving the order.

In addition, the Marketing Platform will simultaneously send an order confirmation email to the member partner, who may also contact you, where appropriate, to make additional instructions about your purchase.

The member will send you directly the invoice corresponding to the contracted services.

In any case, you can download all the documentation related to the contracted tourist experiences, activities or services from your client area of the Marketing Platform.

SPECIFIC CONDITIONS ON TOURIST EXPERIENCES, ACTIVITIES OR SERVICES

We inform you that, in addition to being applicable these general conditions and terms, it is possible that, in certain experiences, activities or tourist services, specific conditions may apply. These specific conditions will be published in a visible place and will be preferentially applied to these general conditions. In addition, once the purchase is made, these conditions will be sent.

In case of doubt, you can consult us before contracting the activity.

The dates and times of the tourist experiences, activities or services published on the Marketing Platform have been pre-established by the adhered partners and do not allow any type of modification. On certain occasions, when the nature of the activity itself requires it, such as private and personalized experiences, it may be possible to arrange a schedule on demand. In any case, you should contact the affiliated establishment to specify these questions directly.

It is essential that users show up on time at the establishments or places where the tourist experiences, activities or services will be provided, being able to start the tourist experiences, activities or services without you in case of delay, without prejudice to the penalties that they may.

The duration of the tourist experiences, activities or services is indicative, and there may be small variations in them.

On the other hand, activities may be suspended for just cause, or in cases of force majeure, when unforeseeable or, even foreseeable, unavoidable circumstances occur. These circumstances will include those related to the COVID19 pandemic.

If you have any questions about tourist experiences, activities or services, you can contact the member who provides said service at any time, through the telephone or contact means that we provide in the purchase documentation.

The documentation of the purchase of the tourist experiences, activities or services must be presented to the member that provides the service, either by means of a paper copy, or in digital format (.pdf, QR code,….)

In cases where the experiences, activities or tourist services included transfers in means of transport, the specific conditions of these transports will be indicated, such as supplements for luggage, maximum places, times and places of stopping, stops, etc.

PRICES

The prices of the experiences, activities or services will be perfectly identified and clear, always being expressed in Euros (€).

If you pay with a credit card with another currency, the current exchange rate will be applied by the financial entity in charge of carrying out the economic transactions for the Marketing Platform.

All prices will be marked with all taxes included, especially the value added tax (VAT) at the corresponding tax rate at all times.

The prices will include all the necessary concepts to provide the tourist experiences, activities or services. In any case, it is possible that the adhered member offers the user other complementary services, always voluntarily and freely (not conditional on the purchase of tourist experiences, activities or services), which the user may purchase directly from the adherent member, paying to this is the cost of said complementary services.

SHIPPING COSTS

The services provided on the platform are experiences, activities or services, so normally they will not entail shipping costs.

If any product or service involves shipping costs, they will be specified separately and clearly and concisely. In any case depending on the destination, the amount of the order, the weight and volume. Etc …

In the event that you have chosen a product or service that requires shipping, you will be informed of the expected delivery time.

For shipments outside the European Union, restrictions may apply, as well as additional costs such as customs duties.

PAYMENT METHODS

The purchase of tourist experiences, activities or services will be paid only through the credit or debit card.

Depending on the number of tourist experiences, activities or services that you have added to your cart, one or more payments will be made, in batches, one each of the partners attached to our Marketing Platform that offers tourist products or activities.

All payments are made directly to the member that offers the product or tourist activity, without any intermediation by the Galician wine routes, which are only available to the Platform as an e-marketplace.

Financial operations are insured by a financial institution in accordance with the payment service provider regulations (PSD and PSD2).

Purchases are made in a secure server environment under SSL (Secure Socket Layer) protocol and all communications are transmitted encrypted under 128-bit encryption, which ensures the highest level of protection for communications.

Visa, Master Card and American Express have developed a system to make secure payments on the Internet. With the Secure Electronic Commerce system, the card issuer (bank or savings bank) identifies the cardholder before authorizing the payment.

The data of your card and your password are protected by this system from its introduction.

Once the identification is completed, the Issuer communicates to the member and the Marketing Platform that the cardholder is making the purchase so that they can complete the process. If the identification has not been satisfactory, the Issuer communicates it to the adhered partner and the Marketing Platform so that they can proceed accordingly.

This window is out of the control of the adhered partner and the Marketing Platform, so it is the responsibility of the Issuer or any incident that may arise.

As a customer, you have the obligation to notify the Marketing Platform of any undue or fraudulent charge on the card used for the purchase in the shortest time possible, in order to mitigate and resolve the incident as soon as possible.

CHANGES AND MODIFICATIONS POLICY

The final consumer may make changes to their purchase as long as the conditions of the experience, activity or service allow it and there is availability.

When an experience, activity or service indicates changes are not allowed, the final consumer may not request any type of modification.

For changes and returns, you must contact the member who has offered the experience, activity or service.

CANCELLATION AND RETURN POLICY

As a customer, you are the final consumer of tourist experiences, activities or services, so you will have the rights established by Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws (hereinafter LGDCU).

Your rights regarding cancellations will depend on the specific and particular conditions that each member member agrees on regarding the experiences, activities or tourist services that it offers. In any case, this information will appear clearly expressed in the description of the tourist experiences, activities or services, and will also be sent in the order confirmation email.

Therefore, to each service its specific cancellation conditions will be applicable, which will establish the cancellation period and if there is any type of penalty or not.

In any case, cancellations will be managed directly by the adhered partners, who assume this responsibility with their clients.

We remind you that the ENOTURISMO DE GALICIA marketing platform does not offer package tours or tour packages, so each tourist experience, activity or service is provided by a different economic operator without any relationship between them, and without the Marketing Platform making the sale of these services, since it is carried out directly by the adhered partners.

APPLICABLE LAW AND JURISDICTION

The terms and conditions of the contract are subject to Spanish Law. Controversies that may arise in the contracting of services on the Marketing Platform must be aired in the civil jurisdictional order, the parties expressly submitting, and waiving their own jurisdiction, to the Courts and Tribunals of Santiago de Compostela.

The client or user declares to know and expressly accept these general terms and conditions, agreeing with them and complying with them.
